Terms of Service

By accessing, browsing, or using DaniKConnections ("the Service", "we", "us", "our"), you agree to be legally bound by these Terms of Service ("Terms") in their entirety. If you do not agree to every provision of these Terms, you must immediately stop using the Service. Your continued use of the Service at any time constitutes your full acceptance of the then-current Terms, including any updates or modifications.

DaniKConnections provides an AI-powered behavioral interview preparation platform based on the STAR (Situation, Task, Action, Result) method. Features include written and voice practice sessions, answer scoring, coaching feedback, answer rewrites, and story storage. The Service is intended solely as a self-directed practice tool and is provided for informational and educational purposes only.

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement and that all information you provide is accurate and complete.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not share, sell, transfer, or permit another person to use your account. You agree to provide accurate, current information and to keep your account information updated. DaniKConnections is not liable for any loss or damage arising from unauthorized access to your account. Notify us immediately at support@danikconnections.com if you suspect any unauthorized use.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Impersonate another person, misrepresent your identity or affiliation, or provide fraudulent or materially misleading information
• Attempt to reverse engineer, decompile, scrape, crawl, or extract data, source code, prompts, models, or other components from the Service
• Use bots, scripts, or other automated means to access the Service without our prior written permission
• Circumvent subscriptions, usage limits, access controls, security measures, or other technical restrictions
• Share your account with others or resell access to the Service
• Submit content that is harmful, abusive, discriminatory, deceptive, defamatory, or infringes the privacy, intellectual property, confidentiality, or other rights of any person
• Submit another person's personal information, an employer's trade secrets, confidential interview materials, or other information you do not have the right to use
• Upload malware or interfere with the availability, security, integrity, or intended operation of the Service
• Use the Service or its outputs to develop, train, benchmark, or improve a competing product or service, except as permitted by applicable law

Some features and products require payment. By completing a purchase, you authorize our payment processor to charge the payment method you provide for the displayed price, applicable taxes, and any recurring charges clearly disclosed before purchase.

• Subscriptions. Subscriptions automatically renew for successive billing periods unless cancelled before the next renewal date. Fees are billed in advance. You may cancel through your account or available billing-management tools, and paid access will ordinarily continue through the end of the current billing period.
• Price changes. We may change subscription prices or included features with reasonable advance notice when required by applicable law. A price change will apply no earlier than your next renewal after the effective date stated in the notice.
• Failed payments. We may suspend paid access if a charge is declined, reversed, disputed, or otherwise remains unpaid.
• Digital products and bundles. Ebooks, workbooks, downloads, and time-limited access bundles are licensed for your personal, noncommercial use and may not be copied, redistributed, resold, or publicly shared. You are responsible for downloading and securely storing purchased files made available to you.
• Promotions. Coupons and promotional offers may be subject to eligibility requirements, expiration dates, product restrictions, and limits on combination or reuse. Promotions have no cash value.

Except where required by applicable law or expressly stated at purchase, sales are final and refunds are issued at our discretion. Cancelling a subscription stops future renewals but does not automatically refund charges already incurred.

Except where required by applicable law, dissatisfaction with AI-generated feedback, disagreement with a score or recommendation, failure to obtain a desired interview or employment outcome, a change of mind, failure to cancel before a renewal, accent or voice-recognition limitations disclosed in these Terms, or temporary interruptions and technical issues that do not materially prevent use of the Service do not entitle you to a refund.

If a verified technical failure materially prevents access to a paid feature or purchased digital product, DaniKConnections may, at its discretion, provide troubleshooting assistance, replacement access, an account credit, an extension of service, or a full or partial refund. Nothing in this refund policy limits any right or remedy that cannot lawfully be waived.

The Service uses artificial intelligence to generate coaching feedback, scores, and answer rewrites. You expressly acknowledge and agree that:

• All AI-generated content is for practice and informational purposes only
• Nothing on the Service constitutes professional career, legal, employment, or psychological advice
• AI-generated feedback reflects automated analysis only and may be inaccurate, incomplete, or misleading
• The AI cannot accurately predict how any human interviewer, hiring manager, or employer will evaluate your responses
• You should consult qualified professionals for career guidance and should use this Service as just one of many preparation resources

DaniKConnections is not responsible for any decisions you make, or actions you take, in reliance on AI-generated content.

DANIKCONNECTIONS MAKES NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES OF ANY KIND — EXPRESS OR IMPLIED — THAT USE OF THE SERVICE WILL:

• Result in obtaining a job, interview, job offer, promotion, or any other employment outcome
• Improve your performance in any interview, assessment, or hiring process
• Meet the expectations or requirements of any specific employer, recruiter, or hiring platform
• Accurately predict how any interviewer will assess, score, or react to your answers
• Lead to any measurable improvement in your career prospects or earning potential

Job outcomes depend entirely on factors outside DaniKConnections' control — including but not limited to employer requirements, market conditions, hiring manager preferences, economic factors, and individual circumstances. DaniKConnections shall have no liability whatsoever for any employment-related outcome, or lack thereof, arising from your use of the Service.

DaniKConnections is committed to improving the usability and accessibility of the Service. However, the Service is continually evolving and may not currently conform to every accessibility standard or work equally well with every browser, device, assistive technology, or accessibility configuration. Some features, including interactive, audio, voice, and AI-powered features, may present additional limitations. We do not represent or warrant that every feature will be fully accessible to every user at all times.

The Service is currently designed, tested, and supported primarily for English-language use. We do not currently guarantee support for other languages, translations, or multilingual input or output. AI-generated analysis, scoring, feedback, transcription, and voice features may be inaccurate, incomplete, delayed, or unavailable when used in a language other than English.

Voice recognition and transcription performance can vary significantly based on factors outside our control, including accent, dialect, pronunciation, speech pattern, speaking pace, voice characteristics, disability or speech difference, microphone quality, background noise, internet connection, device, browser, and third-party technology. The Service may misunderstand, omit, or incorrectly transcribe spoken content, and we do not guarantee that voice features will accurately recognize or evaluate every speaker. Users who experience difficulty with voice features may use available written-practice features where appropriate.

If you experience an accessibility barrier or need assistance accessing the Service, please contact us at support@danikconnections.com and describe the feature and assistance requested. We will review reasonable requests and available alternatives in accordance with applicable law. Nothing in these Terms limits any right or remedy that cannot lawfully be waived.

All content, features, and functionality of the Service — including text, graphics, logos, prompts, scoring systems, educational materials, designs, and software — are owned by DaniKConnections or its licensors and protected by applicable intellectual property laws. Except for the limited right to use the Service under these Terms, no right, title, or interest in the Service is transferred to you. All rights not expressly granted are reserved.

You retain any ownership rights you have in interview answers, saved stories, recordings, and other content you submit ("Your Content"). You represent that you have all rights and permissions necessary to submit Your Content and permit us to process it.

You grant DaniKConnections a nonexclusive, worldwide, royalty-free license to host, store, reproduce, transmit, format, transcribe, analyze, and otherwise process Your Content solely as reasonably necessary to operate, secure, support, and improve the Service, provide requested features, comply with law, and engage service providers acting on our behalf. This license is subject to our Privacy Policy. We do not use Your Content to train AI models.

Subject to these Terms, you may use the scores, feedback, rewrites, and other output generated for you for your personal interview preparation. AI output may not be unique, may be similar to output provided to others, and may not qualify for intellectual property protection. You are responsible for reviewing output and ensuring that your use of it is accurate, lawful, and appropriate.

The Service relies on third-party providers for functions such as payment processing, hosting, email delivery, artificial intelligence, transcription, and voice functionality. We do not control and are not responsible for the independent acts, omissions, availability, security, or performance of third-party services. Your use of certain third-party features may also be governed by the provider's terms and policies.

We may add, modify, limit, suspend, or discontinue any part of the Service; establish or change usage limits; perform maintenance; release beta or experimental features; or stop supporting particular devices, browsers, or integrations. We will provide notice of material changes affecting paid services when required by applicable law.

We may reject, remove, restrict, or preserve content, and may limit, suspend, or terminate access to all or part of the Service, when we reasonably believe it is necessary to:

• Enforce these Terms or protect the Service, our users, or third parties
• Investigate suspected fraud, abuse, unauthorized access, payment disputes, or security threats
• Prevent legal or regulatory exposure or comply with a law, court order, or governmental request
• Address repeated intellectual-property violations or other unlawful conduct

Where practicable, we may provide notice or an opportunity to correct a violation, but we may act immediately when we reasonably determine that delay could create harm or legal risk. Termination does not eliminate payment obligations or other provisions that by their nature should survive termination.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES WHATSOEVER, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF:

• MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR FEEDBACK
• UNINTERRUPTED OR ERROR-FREE OPERATION
• FREEDOM FROM VIRUSES OR HARMFUL COMPONENTS
• SUITABILITY OF AI-GENERATED CONTENT FOR CAREER, EMPLOYMENT, OR ANY OTHER PURPOSE
• COMPATIBILITY WITH EVERY DEVICE, BROWSER, ASSISTIVE TECHNOLOGY, OR ACCESSIBILITY CONFIGURATION
• ACCURATE RECOGNITION, TRANSCRIPTION, ANALYSIS, OR SCORING OF ANY LANGUAGE, ACCENT, DIALECT, SPEECH PATTERN, OR VOICE

USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK. DANIKCONNECTIONS EXPRESSLY DISCLAIMS ALL LIABILITY ARISING FROM YOUR RELIANCE ON THE SERVICE OR ANY CONTENT GENERATED BY IT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DANIKCONNECTIONS, ITS PARENT COMPANY, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SUCCESSORS SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR:

• Any direct, indirect, incidental, special, consequential, exemplary, or punitive damages
• Loss of employment, income, wages, benefits, business opportunity, or career advancement
• Loss of data, goodwill, reputation, or profits
• Damages arising from reliance on AI-generated feedback, scores, coaching, or rewrites
• Any outcome of any interview, hiring process, assessment, or employment decision
• Any decision made or action taken based on the Service or its content
• Any interruption, suspension, or termination of the Service
• Unauthorized access to or alteration of your data or account
• Any other matter relating to or arising out of your use or inability to use the Service

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED — WHETHER CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE — AND EVEN IF DANIKCONNECTIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH THE SERVICE IS TO DISCONTINUE USE OF THE SERVICE. IN NO EVENT SHALL DANIKCONNECTIONS' TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO DANIKCONNECTIONS IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).

You agree to indemnify, defend, and hold harmless DaniKConnections and its officers, directors, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit to the Service. You agree to reasonably cooperate in the defense of a covered claim and not to settle a claim in a manner that imposes liability or obligations on DaniKConnections without our prior written consent. We reserve the right to assume control of the defense of any covered matter.

We may modify these Terms as the Service, our practices, or applicable laws change. We will provide reasonable advance notice of material changes through the Service, by email, or by another appropriate method when required by applicable law. Changes addressing new features, security risks, or legal requirements may take effect sooner. Your continued use of the Service after the stated effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration against DaniKConnections.

If we do not enforce a provision of these Terms, that does not waive our right to enforce it later. You may not assign or transfer your account or any rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, financing, sale of assets, or operation of law.

Except as expressly stated, these Terms do not create rights for any third party. Sections concerning intellectual property, user content and output, payments owed, disclaimers, limitations of liability, indemnification, dispute-related provisions, and any other provisions that by their nature should survive will remain effective after suspension, termination, or account deletion.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DaniKConnections with respect to the Service and supersede all prior or contemporaneous communications, agreements, or understandings, whether written or oral.

If you voluntarily provide suggestions, ideas, or other feedback about the Service, you grant us permission to use that feedback without restriction, confidentiality obligation, or compensation. This provision does not convert private interview answers or practice content submitted for analysis into general product feedback.
